SECTION 1: LEGALLY BINDING TERMS OF SALE & USE

1.1 Agreement Overview

This document constitutes a legally binding agreement between you (the “Customer,” “User,” or “Purchaser”) and Indus Imports LLC (“Company,” “we,” “our,” or “us”), a manufacturer and distributor of traditional Indian fitness tools, including but not limited to Indian Clubs, Steel Clubs, Maces (Gada), and other weighted movement instruments (“Products”).

By purchasing, using, receiving, handling, or interacting with any Product sold or distributed by Tagda Raho, you irrevocably agree to these Terms, even if you do not read them in full.

No product may be purchased, used, or gifted unless this Agreement is accepted in full.

1.2 Legal Binding via Digital Interaction

  • Clicking “I Agree,” checking a box, placing an order, browsing our Site, or continuing past the cart page constitutes your digital signature and has the same legal force as a signed contract.

  • This agreement is enforceable under U.S. law, including digital signature laws such as the E-SIGN Act and the Uniform Electronic Transactions Act (UETA).

1.3 Age Requirement

  • You must be at least 18 years old to purchase or use our Products.

  • If a Product is given to or used by a minor, the adult purchaser assumes full legal, financial, and physical responsibility.

SECTION 2: FULL ASSUMPTION OF RISK & INJURY WAIVER

2.1 Dangerous Nature of Equipment

You acknowledge that:

  • These Products are heavy, fast-moving, blunt instruments requiring strength, coordination, mobility, and control.

  • Injury, property damage, or death may occur due to:

    • Improper use

    • Improper instruction or lack of training

    • Improper flooring, environment, footwear, or distractions

    • Environmental conditions (e.g., wet floors, ceiling fans, pets, children nearby)

    • Loss of grip due to sweat, fatigue, or faulty grip technique

2.2 Examples of Known Risks

These include, but are not limited to:

  • Sprains, tears, fractures, concussions, head trauma, dental injuries, dislocations

  • Spinal injuries, slipped discs, rotator cuff tears, lacerations

  • Equipment rebound injuries or loss of balance

  • Injury to others in the vicinity

  • Damage to ceilings, floors, lights, furniture, mirrors, and electronics

2.3 Misuse Clause

Misuse includes, but is not limited to:

  • Throwing the Product

  • Flipping, balancing on, or using it for gymnastics

  • Using while under the influence of alcohol or medication

  • Letting pets or children interact with it

  • Transporting without a protective bag or leaving it in hot cars

2.4 Total Assumption of Risk

You accept all risks, known and unknown, foreseeable and unforeseeable, related to use, storage, transportation, and exposure to our Products.

2.5 No Responsibility for Third-Party Use

  • You are responsible for anyone else who uses the Product, including clients, friends, family, or social media followers.

  • You may not sue the Company if someone else is injured, including during group workouts, classes, or online tutorials.

2.6 No Refunds for Injury or Misuse

Refunds will not be issued for:

  • Injuries sustained using the Product

  • “Disappointment” in performance

  • Inability to use due to physical condition, health, or lack of training

  • Buyer’s remorse, regardless of cause

SECTION 3: COMPLETE WAIVER OF LIABILITY

To the fullest extent permitted by law, you hereby:

  • Release, waive, and forever discharge Indus Imports LLC, its owners, partners, affiliates, employees, agents, distributors, sponsors, successors, and assigns from any and all claims, liabilities, demands, suits, losses, damages, expenses, or causes of action.

This includes:

  • Negligence (active or passive)

  • Defective design or product failure

  • Lack of instruction or safety guidelines

  • Alleged misrepresentation or non-disclosure

3.1 No Class Actions / Group Claims

  • You agree to resolve any disputes individually and waive all rights to participate in class actions, mass arbitrations, or representative actions.

3.2 Indemnification

You agree to fully indemnify and hold harmless Indus Imports LLC against any and all claims arising from your use, including:

  • Third-party injuries

  • Property damage

  • Legal fees resulting from your breach of this agreement

SECTION 4: RETURNS, SHIPPING & WARRANTY

  • Do not use any Product that appears damaged on delivery. Notify us immediately.

  • All Products are sold “as-is” and without warranties (express or implied), including warranties of fitness or merchantability.

SECTION 5: LEGAL JURISDICTION, ARBITRATION & DISPUTE RESOLUTION

  • This Agreement shall be governed by the laws of the State of Colorado, regardless of where you reside.

  • All disputes must be resolved via binding arbitration in Denver, Colorado.

  • No jury trials or class actions are allowed.

  • You waive all rights to punitive damages, emotional distress claims, or indirect liability.

SECTION 6: CHILDREN UNDER 13

  • This Site and our Products are not intended for children under 13.

  • We do not knowingly collect information from minors.

  • If you become aware of such use, please notify us and we will delete the data.

SECTION 7: ENTIRE AGREEMENT & FINALITY

  • This Agreement is the complete and exclusive statement of your agreement with Indus Imports LLC.

  • Any part found unenforceable shall not affect the rest.

  • This Agreement survives product delivery, resale, gift, or change in ownership.
